What to do first when you recieve a DUI

There are many things that must be done when you get arrested for a DUI but the first involves your license. As soon you are released from jail due to a Dade DUI, Broward DUI, or Palm Beach DUI, you must contact an attorney. This is so vital because your license is immediately at issue.

If you did not give a breach, urine, or in some cases blood when requested by a police officer, you license is suspended for one year. This suspension can be withdrawn for many reasons but only a trained attorney knows the law and how to protect your rights. Once arrested, the traffic ticket you received for a DUI is your license for ten days. During this time, you must request a formal hearing with the department of motor vehicles. This request has to be done within ten days of your Dade DUI, Broward DUI, or Palm Beach DUI.

If you do not request this hearing within these ten days, you and your attorney cannot challenge your one year suspension. If you are successful challenging your one year suspension, your license will be immediately reinstated.

If you gave a breath same the day of your Dade DUI, Broward DUI, or Palm Beach DUI, and this sample is over the legal limit of .08, then your license is immediately suspended for 6 months. Your DUI ticket is again your license for the next ten days. Again, you and your attorney can challenge your suspension if done so within ten days of your Dade DUI, Broward DUI, or Palm Beach DUI.

The second reason that you shouldn’t pay your Palm Beach traffic ticket, Broward traffic ticket, or Dade traffic ticket again is due to points. If you just pay your traffic ticket, you will be given points which can affect your insurance rates.

Anytime your insurance company sees that you were given points for a West Palm traffic ticket, Broward traffic ticket, or Dade traffic ticket, they most assuradely they will raise your rates. This can mean add up to over $1,000.00 a year in some circumstances when if you simple hired an attorney for a small fee, this could have been avoided.

Why not just pay? This is the question that I'm faced with on a daily basis. When someone gets a traffic citation, there is a fine for any infraction one receives. Many people, including my closest friends, think why hire an attorney when I could just pay the ticket for a little less than what an attorney would cost. The answer is very simple and can be summed up in one word…..POINTS!

Points, even just a few, can hurt you in more ways than one. There are two negative affects that points can have on your life and wallet. I will discuss one and the second later.

1. If you receive too many points, your license can be suspended. If you are caught driving while your license is suspended, you will be charged with "Driving While License Suspended", which is a misdemeanor offense. Simple put, you are now being charged with a criminal offense. The cost of an attorney is so much more when he or she is defending a criminal charge as opposed to a simple infraction.

What to Wear to Court

As I was in court today, I noticed something, a man wearing basketball shorts, a t-shirt, and sandals. This, I submit, is not proper attire for court.

If you are arrested and you have checked your court date on the Clerk’s website (Broward, Dade, Palm Beach), then make sure you are wearing something that demonstrates to the Judge that you respect Him/Her as well as the courtroom.

What are your rights
